BackgroundStreet-connected children and youth in low- and middle-income countries have multiple vulnerabilities in relation to participation in research. These require additional considerations that are responsive to their needs and the social, cultural, and economic context, while upholding core ethical principles of respect for persons, beneficence, and justice. The objective of this paper is to describe processes and outcomes of adapting ethical guidelines for SCCY’s specific vulnerabilities in LMIC.MethodsAs part of three interrelated research projects in western Kenya, we created procedures to (...) address SCCY’s vulnerabilities related to research participation within the local context. These consisted of identifying ethical considerations and solutions in relation to community engagement, equitable recruitment, informed consent, vulnerability to coercion, and responsibility to report.ResultsSubstantial community engagement provided input on SCCY’s participation in research, recruitment, and consent processes. We designed an assent process to support SCCY to make an informed decision regarding their participation in the research that respected their autonomy and their right to dissent, while safeguarding them in situations where their capacity to make an informed decision was diminished. To address issues related to coercion and access to care, we worked to reduce the unequal power dynamic through street outreach, and provided access to care regardless of research participation.ConclusionsAlthough a vulnerable population, the specific vulnerabilities of SCCY can to some extent be managed using innovative procedures. Engaging SCCY in ethical research is a matter of justice and will assist in reducing inequities and advancing their health and human dignity. (shrink)

A central area of current philosophical debate in the foundations of mathematics concerns whether or not there is a single, maximal, universe of set theory. Universists maintain that there is such a universe, while Multiversists argue that there are many universes, no one of which is ontologically privileged. Often model-theoretic constructions that add sets to models are cited as evidence in favour of the latter. This paper informs this debate by developing a way for a Universist to interpret talk that (...) seems to necessitate the addition of sets to V. We argue that, despite the prima facie incoherence of such talk for the Universist, she nonetheless has reason to try and provide interpretation of this discourse. We present a method of interpreting extension-talk (V-logic), and show how it captures satisfaction in `ideal' outer models and relates to impredicative class theories. We provide some reasons to regard the technique as philosophically virtuous, and argue that it opens new doors to philosophical and mathematical discussions for the Universist. (shrink)

This book brings together contributions from academics and practitioners to explore the implications of legal pluralism for legal development.

This study examined patterns of auxiliary provision and omission for the auxiliaries BE and HAVE in a longitudinal data set from 11 children between the ages of two and three years. Four possible explanations for auxiliary omission—a lack of lexical knowledge, performance limitations in production, the Optional Infinitive hypothesis, and patterns of auxiliary use in the input—were examined. The data suggest that although none of these accounts provides a full explanation for the pattern of auxiliary use and nonuse observed in (...) children's early speech, integrating input-based and lexical learning-based accounts of early language acquisition within a constructivist approach appears to provide a possible framework in which to understand the patterns of auxiliary use found in the children's speech. The implications of these findings for models of children's early language acquisition are discussed. (shrink)

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. At the 2022 Clinical Ethics Unconference, the authors perceived a significant lack of racial and ethnic diversity, which was consistent with their experiences in other clinical ethics settings. As a result, they convened a working group to address the pervasive lack of diversity present in the field of clinical ethics and to propose strategies to increase the representation of people from racial and ethnic minority populations. This article identifies the harms associated with the lack of diversity in the healthcare setting (...) and translates these to the field of clinical ethics. The article then proposes a framework that may be used to help diversify the field of clinical ethics. Specifically, the authors identify existing barriers to appropriate diversity, actionable steps to increase diversity, and tools the field can utilize to systematically assess its progress with respect to achieving diversity. This paper explores the classical idea of complementarity in mathematics concerning the relationship of intuition and axiomatic proof. Section I illustrates the basic concepts of the paper, while Section II presents opposing accounts of intuitionist and axiomatic approaches to mathematics. Section III analyzes one of Einstein's lecture on the topic and Section IV examines an application of the issues in mathematics and science education. Feltets idealer kan dog være vanskelige at leve op til i praksis. Denne caseanalyse undersøger en rapport, hvor de dialogiske idealer for Filosofi med børn beskrives sammen med praksiseksempler, og analysen viser, at den faktiske undervisning ikke lever op til idealerne. How many words is a bilingual 2-year-old supposed to know or say in each of her languages? Speech and language therapists or researchers lack the tools to answer this question, because several factors have an impact on bilingual language skills: gender, amount of exposure, mode of acquisition, socio-economic status and the distance between L1 and L2. Unfortunately, these factors are usually studied separately, making it difficult to evaluate their weight on a unique measure of vocabulary. The present study measures the (...) contribution of the following factors to the vocabulary scores of bilingual toddlers: i) gender; ii) sibling ranking; iii) relative amount of exposure to each language; iv) mode of exposure; v) SES; vi) linguistic distance; vii) language spoken between parents. Close to the child’s second birthday, parents of 278 UK-based bilinguals completed successively: a 100-word version of the Oxford-CDI, the CDI in the child’s Additional Language, a family questionnaire, and the Language Exposure Questionnaire. Thirty-six British-English-AL pairs were considered, with languages contrasted on a second-language-learning scale : for example, Dutch and French are close to British-English, while Polish or Cantonese are more distant. Data from the corpus were included in two mixed-effect models, one with the English scores in comprehension as the dependent variable, and the other with production scores. The seven factors listed above were included as predictors. The amount of English exposure was the strongest predictor of comprehension scores = 9.35, p <.005, β = 0.02, t = 3.08, p <.005), followed by the language that parents speak between themselves = 14.94, p <.001, β = 1.37, t = 3.76, p <.0005), linguistic distance = 6.92, p <.01, β = -0.74, t = -2.66, p <.01) and age = 4.86, p <.05, β = 0.55, t = 2.17, p <.05). In production, gender = 13.57, p <.0005, β = -0.91, t = -03.72, p <.0005), amount of exposure to English = 13.57, p <.0005, β = -0.91, t = -03.72, p <.0005), the language that parents speak between themselves = 11.85, p <.005, β = 1.09, t = 3.41, p <.001), and the mother’s occupation = 4.51, p <.05, β = 0.63, t = 2.13, p <.05) were the significant predictors. The more English parents use to address one another, the more English words the child says and understands. This surprising result could be simply explained by the fact that parents who speak English together are also more likely to speak English to their child. The main results of this study is that linguistic distance is a powerful predictor of toddlers’ vocabulary in English, with children learning two close languages growing their vocabulary faster than those learning distant languages. In previous Ethics briefings 1 we have highlighted the developments in the case of Bell & Another v the Tavistock and Portman NHS Foundation Trust. The case concerned a judicial review of the practice of prescribing puberty blocking treatment to children and young people at the Gender Identity Development Service managed by the Tavistock and Portman NHS Foundation Trust. The Court of Appeal in its judgement2 found the Trust’s practices to be lawful, and overturned previous guidance given by the High (...) Court which had contradicted the 'Gillick principle' regarding whether a child or young person could consent to medical treatment, without the consent of its parent. Despite this legal success, concerns over the GIDS continued. In September, NHS England commissioned an independent and wide-ranging review of gender identity services for children and young people led by Dr Hilary Cass, past president of the Royal College of Paediatrics and Child Health. Dr Cass’s Interim review, published in March,3 has resulted in a decision by NHS England to close the GIDS at the Trust by Spring 2023, and replace it with regional centres at existing children’s hospitals offering more 'holistic care' with ’strong links to mental health services’. It is proposed that regional centres will be established at Great Ormond Street Hospital, and Alder Hey Children’s NHS Foundation Trust. Dr Cass was critical of the clinic’s failure to collect sufficient data on the impact of puberty blockers in under-16s. …. (shrink)

The relativistic transformation equations for the pressure, volume, energy, and momentum of a gas in a closed container are discussed. Considerations are given in support of pressure noninvariance, volume dilatation, and the fact that the energy and momentum of a gas form a four-vector. It is shown that the relativistic transformation formula for temperature resulting from the Lorentz invariance requirement of the equation of state of an ideal gas coincides with the Ott formula.

In 1890 a man sold the rights to his body after death to the Royal Caroline Institute in Sweden for research purposes. Later, he tried to return the money and cancel the contract. In the subsequent lawsuit, the court held that he must turn his body over to the Institute and also ordered him to pay damages for diminishing the worth of his body by having two teeth removed.Today, it would be an anathema for a person's body to be (...) used against his wishes and for a research subject not to be allowed to withdraw from a study. In fact, the Uniform Anatomical Gift Act allows people to change their minds and withdraw a previous agreement to donate organs and tissue after their death and the federal research regulations allow people to withdraw from studies without penalty or loss of benefits. Traditional state v. state war is largely a relic. How then does a nation-state protect itself - preemptively - against the unseen enemy? Existing international law - the Caroline Doctrine, UN Charter Article 51, Security Council Resolutions 1368 and 1373 - do not provide sufficiently clear guidelines regarding when a state may take preemptive or anticipatory action against a non-state actor. This article proposes rearticulating international law to allow a state to act earlier provided sufficient intelligence is available. After (...) examining international law, this article proposes a process-based "strict-scrutiny" approach to self-defense. Under this approach, the executive will have to convince a court, based on relevant, reliable, viable, and corroborated intelligence, that preemptive action is appropriate. This process leads to a check on the power o the executive by placing a judicial check on preemptive action, consequently establishing objective legal criteria for operational counterterrorism. Viewing animals as a disposable resource is by no means novel, but does milking the cow for all its worth now represent a previously unimaginable level of exploitation? New technology has intensified milk production fourfold over the last 50 years, rendering the cow vulnerable to various and frequent clinical interventions deemed necessary to meet the demands for dairy products. A major question is whether or not the veterinary code of practice fits, or is in ethical tension, with the administration of (...) ‘efficient’ techniques, such as artificial insemination, to enhance reproduction levels among cattle? Vets perform these interventions and their ‘success’ is measured by the maximisation of milk production, requiring perpetually pregnant cows. Our empirical research on 33 farm vets explores how their professional ethical code promising to protect the welfare of the animal ‘above all else’, is increasingly in conflict with, and subordinate to, the financial demands of clients. Since vets cannot stand outside of the productive power–knowledge relations that have intensified the consumption of animal bodily parts and secretions, we argue that a process of adiaphorization’ occurs, whereby humans become morally indifferent to cruel practices deemed necessary to our consumerist ways of life. However, this indifference reflects and reinforces a taken-for-granted anthropocentrism among vets, animal owners and the population generally. We suggest that posthumanist ideas may offer new insights for the study of human–animal relations in organisations that transcend the coercive and negative impact of discourses that deny any alternative to prevailing farm/veterinary practices. Our study has major implications in relation to climate warming and zoonotic diseases, both partly derived from our unethical relationship to animals, that are increasingly threatening our, and their, lives. Among the available metaethical views, it would seem that moral realism—in particular moral naturalism—must explain the possibility of moral progress. We see this in the oft-used argument from disagreement against various moral realist views. My suggestion in this paper is that, surprisingly, metaethical constructivism has at least as pressing a need to explain moral progress. I take moral progress to be, minimally, the opportunity to access and to act in light of moral facts of the matter, whether they are mind-independent (...) or -dependent. For the metaethical constructivist, however, I add that moral progress ought also mean that agents come to be or could come to be motivated to act in light of the right kind of moral judgments. Together I take this to mean that, for all forms of constructivism, moral progress must be explained as a form of moral improvement, or agents aspiring to be better sorts of moral agents. In what moral improvement consists differs for various forms of constructivism. Here I distinguish between three different versions of metaethical constructivism: Humean constructivists as represented by Street, Kantian constitutivist constructivists as represented by Korsgaard, and constructivists about practical reason as represented by Carla Bagnoli. I conclude by showing that only constructivism as a view about practical reason can fully account for moral progress qua the opportunity for moral improvement. (shrink)

Standard models of adolescent risk taking posit that the cognitive abilities of adolescents and adults are equivalent, and that increases in risk taking that occur during adolescence are the result of socio emotional differences in impulsivity, sensation seeking, and lack of self-control. Fuzzy-trace theory incorporates these socio emotional differences. However, it predicts that there are also cognitive differences between adolescents and adults, specifically that there are developmental increases in gist-based intuition that reflects understanding. Gist understanding, as opposed to verbatim-based analysis, (...) generally has been hypothesized to have a protective effect on risk taking in adolescence. Gist understanding is also an essential element of informed consent regarding risks in medical decision- making. Evidence thus supports the argument that adolescents’ status as mature minors should be treated as an exception rather than a presumption, because accuracy in verbatim analysis is not mature gist understanding. Use of the exception should be accompanied by medical experts’ input on the bottom-line gist of risks involved in treatment. (shrink)

The seventeenth century witnesses the demise of two core doctrines in the theory of perception: naive realism about color, sound, and other sensible qualities and the empirical theory, drawn from Alhacen and Roger Bacon, which underwrote it. This created a problem for seventeenth century philosophers: how is that we use qualities such as color, feel, and sound to locate objects in the world, even though these qualities are not real? -/- Ejecting such sensible qualities from the mind-independent world at once (...) makes for a cleaner ontology, since bodies can now be understood in purely geometrical terms, and spawns a variety of fascinating complications for the philosophy of perception. If sensible qualities are not part of the mind-independent world, just what are they, and what role, if any, do they play in our cognitive economy? We seemingly have to use color to visually experience objects. Do we do so by inferring size, shape, and motion from color? Or is it a purely automatic operation, accomplished by divine decree? -/- This volume traces the debate over perceptual experience in early modern France, covering such figures as Antoine Arnauld, Robert Desgabets, and Pierre-Sylvain Regis alongside their better-known countrymen Rene Descartes and Nicolas Malebranche. On a currently popular reading of Locke, an idea represents its cause, or what God intended to be its cause. Against Martha Bolton and my former self (among others), I argue that Locke cannot hold such a view, since it sins against his epistemology and theory of abstraction. I argue that Locke is committed to a resemblance theory of representation, with the result that ideas of secondary qualities are not representations.

We provide an account of chimpanzee-specific agency within the context of philosophy of action. We do so by showing that chimpanzees are capable of what we call reason-directed action, even though they may be incapable of more full-blown action, which we call reason-considered action. Although chimpanzee agency does not possess all the features of typical adult human agency, chimpanzee agency is evolutionarily responsive to their environment and overlaps considerably with our own. As such, it is an evolved set of capacities (...) for goal-directed behavior, which solves problems that chimpanzees naturally encounter. Thus, it ought not be understood as a deficient instance of human agency. (shrink)

The question ‘Why care about being an agent?’ asks for reasons to be something that appears to be non-optional. But perhaps it is closer to the question ‘Why be moral?’; or so I shall argue. Here the constitutivist answer—that we cannot help but have this aim—seems to be the best answer available. I suggest that, regardless of whether constitutivism is true, it is an incomplete answer. I argue that we should instead answer the question by looking at our evaluative commitments (...) to the exercise of our other capacities for which being a full-blown agent is a necessary condition. Thus, the only kind of reason available is hypothetical rather than categorical. The status of this reason may seem to undermine the importance of this answer. I show, however, that it both achieves much of what we want when we cite categorical reasons and highlights why agency is valuable. (shrink)

I consider an underappreciated problem for proponents of the Humean theory of motivation. Namely, it is unclear whether is it to be understood as a largely psychological or largely metaphysical theory. I show that the psychological interpretation of HTM will need to be modified in order to be a tenable view and, as it will turn out, the modifications required render it virtually philosophically empty. I then argue that the largely metaphysical interpretation is the only a plausible interpretation of HTM's (...) central claim that desires are necessary conditions for motivation. This interpretation also fits better with the important roles that HTM plays in both moral psychological and metaethical debates. (shrink)

Most views of agency take acting for reasons (whether explanatory or justifying) to be an important hallmark of the capacity for agency. The problem, however, is that the standard analysis of what it is to act in light of reasons is not sufficiently fine grained to accommodate what we will argue are the myriad types of ways that agents can do so. We suggest that a full account of acting for reasons must also recognize the relationship that agents have with (...) their reasons. We focus on two types of relationships. The first is the traditional case, where agents act in light of reasons that they take to be their own and that they endorse. We describe this as possessing an Endorsement Relationship with one's reasons. A second way of relating to reasons is what we will describe as possessing a Directed Relationship with one's reasons. This includes cases in which agents' actions are the product of reasons but toward which agents do not have an Endorsement Relationship. The Endorsement Relationship is uncontroversial. In this paper, we defend the existence and importance of the Directed Relationship. We show that it is a genuine but overlooked way of relating to, and thereby acting for, reasons. (shrink)

The conception of a ‘law of nature’ is a human product. It was created to play a role in natural philosophy, in the Cartesian tradition. In light of this, philosophers and scientists must sort out what they mean by a law of nature before evaluating rival theories and approaches. If one’s conception of the laws of nature is yoked to metaphysical notions of truth and explanation, that connection must be made explicit and defended. If, on the other hand, one’s aim (...) is to disentangle laws from truth or from explanation, that must be stated and defended as well. If philosophers do not make such assumptions, intuitions, and methodological commitments clear, then it will be impossible to identify the source of disagreement in debates about the laws of nature. Are the conflicts rooted in disagreement about the conclusions reached, or do the background commitments of the combatants block any resolution to the dispute in principle or in practice? (shrink)

Being imitated has a wide range of pro-social effects, but it is not clear how these effects are mediated. Naturalistic studies of the effects of being imitated have not established whether pro-social outcomes are due to the similarity and/or the contingency between the movements performed by the actor and those of the imitator. Similarity is often assumed to be the active ingredient, but we hypothesized that contingency might also be important, as it produces positive affect in infants and can be (...) detected by phylogenetically ancient mechanisms of associative learning. We manipulated similarity and contingency between performed and observed actions in a computerized task. Similarity had no positive effects; however, contingency resulted in greater enjoyment of the task, reported closeness to others, and helping behavior. These results suggest that the pro-social effects of being imitated may rely on associative mechanisms. (shrink)

It can seem obvious that we live in a world governed by laws of nature, yet it was not until the seventeenth century that the concept of a law came to the fore. Ever since, it has been attended by controversy: what does it mean to say that Boyle's law governs the expansion of a gas, or that the planets obey the law of gravity? Laws are rules that permit calculations and predictions. What does the universe have to be like, (...) if it is to play by them? This book sorts the most prominent answers into three families. Laws first arose in a theological context; they govern events only because God enforces them. Those wishing to reverse the order of explanation, and argue that the powers of objects fix the laws, struggled to claim for themselves the results of new science. The stand-off between these two families bred a third which rejects any kind of enforcer for the laws. On this view, laws summarize events; they do not govern anything. This book traces the fortunes of the three families, from their origins to the present day. It uses objections - and the revisions needed to answer them - to produce the best representative of each. Along the way, it tries to settle the rules of this game, the debate over laws of nature. What should we expect from an account of laws? The book aims to help readers develop their own desiderata and judge the merits of the competing positions. (shrink)

John Locke’s claims about relations (such as cause and effect) and mixed modes (such as beauty and murder) have been controversial since the publication of the Essay. His earliest critics read him as a thoroughgoing anti-realist who denies that such things exist. More charitable readers have sought to read Locke’s claims away. Against both, I argue that Locke is making ontological claims, but that his views do not have the absurd consequences his defenders fear. By examining Locke’s texts, as well (...) as the intellectual context in which they were written, I show that Locke’s position is at once radical and thoroughly traditional. (shrink)
